1. Definitions
Client: the contracting party of Frachtmeister International Kft.
Service Provider: Frachtmeister International Kft.
Consumer: a natural person as defined in Section 8:1 of the Hungarian Civil Code (Act V of 2013) acting outside his/her trade, business, or profession.
Contract: the legal relationship established between the Service Provider and the Client.
2. Scope of Application
These General Terms and Conditions apply to all removal, forwarding, storage, packaging, and other logistical services of the Service Provider in Hungary and abroad.
For international transport, the CMR Convention (promulgated by Act II of 1971 in Hungary) shall also apply.
3. Conclusion of the Contract
The contract is concluded when the Service Provider confirms the Client’s order in writing or electronically.
Oral orders must be confirmed in writing by the Client without delay.
4. Performance of the Service
The Service Provider shall perform the ordered service at the agreed place and time.
The Client must provide all necessary information and documents in due time, including customs documents.
The Client must ensure proper access, parking, and other necessary conditions for performance.
5. Subcontractors
The Service Provider is entitled to use subcontractors. The Service Provider shall be liable for subcontractors as if it had acted itself.
In case of mediated services, the invoice shall indicate them separately.
6. Payment and Terms
The Client shall pay the service fee within the deadline indicated on the invoice issued by the Service Provider.
In case of delay, late payment interest may be charged pursuant to Section 6:155 of the Civil Code.
The Service Provider is entitled to request an advance payment.
7. Obligations of the Client
The Client shall accurately designate and adequately pack the items to be transported.
Transport of dangerous goods (e.g., explosives, chemicals) is excluded.
The Client must declare and arrange insurance for valuable items (e.g., jewelry, cash) separately.
8. Liability and Insurance
The Service Provider shall be liable for the goods entrusted to it in accordance with the Hungarian Civil Code and, in the case of international transport, the CMR Convention.
If the Client does not take out separate property insurance, the Service Provider’s liability is limited.
The Service Provider undertakes to remove and return any damaged item to the place of origin at its own expense.
Compensation limit: EUR 4/kg of the actual weight of the damaged or lost item.
Full value insurance is only available upon separate order and payment.
9. Withdrawal and Termination
The Client may withdraw from the contract before the commencement of the service but must reimburse the Service Provider’s incurred costs.
The Service Provider may withdraw from the order under Section 6:213 of the Civil Code if performance becomes impossible or if the Client seriously breaches its obligations.
10. Complaints Handling
The Service Provider accepts complaints at info@frachtmeister.hu.
Complaints will be investigated and answered within 15 days in accordance with Section 17/A of Act CLV of 1997 on Consumer Protection.
11. Disputes
The parties shall primarily attempt to resolve disputes amicably.
If this fails, the court with jurisdiction at the Service Provider’s registered seat shall have exclusive competence.
12. Final Provisions
These General Terms and Conditions shall take effect upon acceptance by the Client.
The Service Provider is entitled to unilaterally amend these Terms and Conditions, which shall be published on its website.
